In granting the lender’s motion to dismiss the Third Party Complaint with prejudice, the Court held that the borrower’s claims for breach of contract, wrongful repossession and sale, conspiracy and violation of the New Jersey Consumer Fraud Act were all barred by the Uniform Commercial Code’s 4-year statute of limitations. Victory obtained for commercial condominium unit owner in vacating default judgment and sheriff’s sale, resulting in preserving client’s equity in condo worth approximately $375,000. The client had lost title to the unit by failing to pay his monthly maintenance fees. The Court agreed that service of process was defective, and that client was deprived of due process of law.
