In these situations mistakes are often made because of the attorney’s inexperience. In fact, failure to comply with one or more of the various procedural deadlines imposed by the Federal Rules of Bankruptcy Procedure and New Jersey’s Local Bankruptcy Rules can have catastrophic consequences for a debtor or creditor.
In September 2016 we successfully obtained a dismissal of attorney ethics charges accusing our client, an experienced bankruptcy lawyer, of knowingly falsifying a bankruptcy petition filed in the United States Bankruptcy Court for the District of New Jersey. The charges were dismissed following a 4-day trial.
