In a December 2023 published decision, the Appellate Division affirmed a trial court ruling where we successfully vacated a tax foreclosure judgment entered against our client and recovered his commercial mix-use property valued in excess of $450,000 more than the amount of the tax lien. The Court agreed that a recent United States Supreme Court decision justified the trial court’s decision. As a result of our efforts, our client’s major retirement asset is preserved. (257-261 20th Ave. Realty v. Roberto, Docket No. A-3315-21 (Dec. 4, 2023).
The plaintiff has filed a petition with the New Jersey Supreme Court seeking further appeal. The Court has yet to rule on the petition.
